If one of you already holds residence in Serbia, family reunification is usually the cheapest permit the other can get, and for an adult reunited with an adult foreigner it brings the right to work with it. The cost is not the fee. It is that the family member’s permit hangs off the sponsor’s: one card in the household is now load-bearing for two. Plan the sponsor’s renewals as if they were everyone’s, because they are.

Checked on 31 October 2026 against welcometoserbia.gov.rs and the Law on Foreigners.

Who can sponsor

welcometoserbia.gov.rs sets out family reunification for:

  • the spouse of a Serbian citizen;
  • the spouse of a foreign citizen who holds temporary or permanent residence, or asylum, in Serbia;
  • a partner in an extramarital union with either of those sponsors;
  • a family member of either.

The Law on Foreigners frames it the same way in Article 55: the sponsor is a Serbian citizen, or a foreigner with approved temporary residence or permanent settlement, and the article defines which relatives count as close family. The portal page does not reproduce that definition, and I am not going to paraphrase a list of relatives from memory. If your case is anything other than a spouse or a minor child, read Article 55 or ask the foreigners’ office before you build a file on it.

The sponsor needs a status first. If you arrived together and neither of you holds a permit yet, there is nobody to reunify with. One of you files on your own ground — work, self-employment, study — and the other follows. Which of you goes first is a real decision, covered in the legal bases.

What the law ties to the sponsor

Article 57 of the Law on Foreigners ties the family member’s permit to the validity of the sponsor’s. In plain terms: the family member’s card cannot outlast the card it was granted on.

That is the line to plan around. It means:

  • The sponsor’s renewal is the household’s renewal. If the sponsor files late, both permits are at risk. Put the sponsor’s window in both calendars — see renewing your boravak.
  • The sponsor’s ground is the household’s ground. A sponsor on a single permit tied to one employer has made the whole household’s status depend on that job.
  • If the relationship ends, the ground ends. The portal says that if the reason a permit was granted ceases, you contact the competent police office. Do that, and get advice, rather than carrying a card whose basis is gone.

The way out of dependence

The law has one. Article 59 provides for independent residence after four years of continuous stay on family reunification — the point at which the family member’s status stops hanging off the sponsor’s. Separately, three years on approved temporary residence is the condition for permanent residence, which the portal applies to temporary residence generally. Check with the office which of those two routes your file fits before you plan on it; this is the kind of question to have answered in writing.

The right to work

welcometoserbia.gov.rs states that adults with an approved reunification permit, based on a relationship with an adult foreign citizen, “automatically get the right to work in the Republic of Serbia.” Read the note on the card itself when you collect it — the portal says the card records whether the holder has the right to work — rather than relying on any summary.

The page does not say the same thing in the same words for a family member of a Serbian citizen. If you are in that position and intend to work, ask, and get the answer before you sign a contract.

What the family member has to show

The general conditions in Article 43 of the law apply: among them, proof of means of subsistence and a registered address. Article 43a exempts a family member of a Serbian citizen from proving means and health insurance. The address requirement still applies to everyone.

So two households with the same flat file different folders:

Spouse of a foreign permit-holderSpouse of a Serbian citizen
Passport, valid three months past the period askedYesYes
Proof of meansYesExempt (Art. 43a)
Health insuranceYesExempt (Art. 43a)
Registered addressYesYes
Proof of the relationshipYesYes
FeeYesYes

The portal does not list the documents on its reunification page; it points to the temporary-residence and visa D lists for your ground. Use those for the exact set.

The slow part is the certificate

The relationship has to be proved, and if it was registered abroad, proved with a foreign document: a marriage certificate, a birth certificate for a child. That document has to be made usable here, which means an apostille or legalisation in the issuing country and a translation by a court translator in Serbia. MUP’s guidance on residence files says proofs not issued by Serbian authorities “shall be translated”, and for permanent residence it asks for a marriage certificate no older than six months — a freshness rule worth expecting elsewhere.

Order the certificate fresh, apostilled, before you fly, and budget weeks rather than days. It is the step that delays more files than any other, and the apostille post goes through it in order. Unmarried partners have the harder file, because an extramarital union has no certificate; ask the office what it accepts as proof before you assemble anything.

Address first

The registered address is the one requirement nobody is exempt from, and it is where reunification files stall for reasons that have nothing to do with family. The flat both of you live in must be one at which both of you can be registered — which means a landlord willing to be visible to the tax authority. If yours is not, that is the problem to solve before the application, and it is the subject of the undeclared landlord.

When this is not the route

If both of you can qualify independently — two remote contracts, two preduzetnik registrations — compare it with two separate permits before choosing reunification. Two permits cost two folders and two fees. One reunification permit costs less, but it turns one person’s renewal, job and relationship into the other’s legal status. For a couple with children or one partner not working, that trade is usually worth it. For two working adults with their own income, two independent permits are the steadier arrangement, and I would pay the second fee.

The verdict, restated

One status first, then the family member on reunification. Expect the foreign certificate, apostilled and court-translated, to be the slowest step. Register the address for both of you. And treat the sponsor’s renewal date as the most important date in the household, because the law makes the family member’s card end when the sponsor’s does.
